AllAlto-ShaamequipmentissoldF.O.B.shippingpoint,andwhenacceptedbythecarrier,suchshipmentsbecomethepropertyoftheconsignee. Shoulddamageoccurinshipment,itisamatterbetweenthecarrierandtheconsignee.Insuchcases,thecarrierisassumedtoberesponsibleforthesafedeliveryofthemerchandise,unlessnegligencecanbeestablishedonthepartoftheshipper. 1.Makeanimmediateinspectionwhiletheequipmentisstillinthetruckorimmediatelyafteritismovedtothereceivingarea.Donotwaituntilafterthematerialismovedtoastoragearea. 2.Donotsignadeliveryreceiptorafreightbilluntilyouhavemadeapropercountandinspectionofallmerchandisereceived. 3.Notealldamagetopackagesdirectlyonthecarrier’sdeliveryreceipt. 4.Makecertainthedriversignsthisreceipt.Ifherefusestosign,makeanotationofthisrefusalonthereceipt. 5.Ifthedriverrefusestoallowinspection,writethefollowingonthedeliveryreceipt: Driverrefusestoallowinspectionofcontainersforvisibledamage. 6.Telephonethecarrier’sofficeimmediatelyuponfindingdamage,andrequestaninspection.Mailawrittenconfirmationofthetime,date,andthepersoncalled. 7.Saveanypackagesandpackingmaterialforfurtherinspectionbythecarrier. 8.Promptlyfileawrittenclaimwiththecarrierandattachcopiesofallsupportingpaperwork. Wewillcontinueourpolicyofassistingourcustomersincollectingclaimswhichhavebeenproperlyfiledandactivelypursued.Wecannot,however,fileanydamageclaimsforyou,assumetheresponsibilityofanyclaims,oracceptdeductionsinpaymentforsuchclaims. Alto-Shaam,Inc.warrantstotheoriginalpurchaserthatanyoriginalpartthatisfoundtobedefectiveinmaterialorworkmanshipwill,atAlto-Shaam'soption,subjecttoprovisionshereinafterstated,bereplacedwithaneworrebuiltpart. Thelaborwarrantyremainsineffectone(1)yearfrominstallationorfifteen(15)monthsfromtheshippingdate,whicheveroccursfirst. Alto-Shaamwillbearnormallaborchargesperformedduringstandardbusinesshours,andexcludingovertime,holidayratesoranyadditionalfees. Thepartswarrantyremainsineffectforone(1)yearfrominstallationorfifteen(15)monthsfromtheshippingdate,whicheveroccursfirst. However,theheatingelementonHaloHeat®cook/holdovensandtherefrigerationcompressoronAlto-ShaamQuickchillers™arewarrantedforaperiodoffive(5)yearsfrominstallation.Thelaborwarrantyisthesameasstatedabove;namely,forone(1)yearfrominstallationorfifteen(15)monthsfromtheshippingdate,whicheveroccursfirst. THISWARRANTYDOESNOTAPPLYTO: 1.Calibration. 2.Replacementoflightbulbsand/orthereplacementofdisplaycaseglassduetodamageofanykind. 3.Equipmentdamagecausedbyaccident,shipping,improperinstallationoralteration. 4.Equipmentusedunderconditionsofabuse,misuse,carelessnessorabnormalconditionsincluding,butnotlimitedto,equipmentsubjectedtoharshorinappropriatechemicalsincluding,butnotlimitedto,compoundscontainingchlorideorquaternarysalts,poorwaterquality,orequipmentwithmissingoralteredserialnumbers. 5.Damageincurredasadirectresultofpoorwaterquality, inadequatemaintenanceofsteamgeneratorsand/orsurfacesaffectedbywaterquality.Waterqualityandrequiredmaintenanceofsteamgeneratingequipmentistheresponsibilityoftheowner/operator. 6.DamagecausedbyuseofanycleaningagentotherthanAlto-Shaam'sCombitherm®Cleanerincluding,butnotlimitedto, damageduetochlorineorotherharmfulchemicals.UseofAlto-Shaam'sCombitherm®CleaneronCombitherm®ovensishighlyrecommended. 7.Anylossesordamageresultingfrommalfunction,includinglossofproductorconsequentialorincidentaldamagesofanykind. 8.Equipmentmodifiedinanymannerfromoriginalmodel, substitutionofpartsotherthanfactoryauthorizedparts, removalofanypartsincludinglegs,oradditionofanyparts. Thiswarrantyisexclusiveandisinlieuofallotherwarranties, expressedorimplied,includingtheimpliedwarrantiesofmerchantabilityandfitnessforaparticularpurpose.InnoeventshallAlto-Shaambeliableforlossofuse,lossofrevenueorprofit, orlossofproduct,orforanyindirectorconsequentialdamages. NopersonexceptanofficerofAlto-Shaam,Inc.isauthorizedtomodifythiswarrantyortoincuronbehalfofAlto-ShaamanyotherobligationorliabilityinconnectionwithAlto-Shaamequipment. ALTO-SHAAM,INC.
